Terms of Service

1. Acceptance of Terms
By downloading, accessing, or using the Tag Everything mobile application ("App") or purchasing physical EveryTags products ("Products"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our App or Products.
2. Critical Safety & AI Image Analysis Disclaimer
Tag Everything is an assistive accessibility tool, not a medical device or certified safety system.
The App utilises automated optical character recognition and artificial intelligence (via Google Vertex AI) to analyse photos, labels, and text. Optical recognition and AI interpretations can be inaccurate, incomplete, or affected by poor lighting, camera angles, or faded print. You must never rely solely on Tag Everything for life-critical, medical, pharmaceutical dosage, severe allergy, or hazardous chemical identification. You remain solely responsible for verifying critical information independently.
3. Hardware Orders, Pricing & Dispatch
All physical tag purchases are processed securely through Stripe. Base prices are set in Australian Dollars (AUD), though international customers may be presented with local currency estimates and checkout options via Stripe. Goods and Services Tax (GST) is not currently charged as we are not registered for GST. International buyers are responsible for any applicable local import duties, taxes, or foreign transaction fees. We reserve the right to refuse or cancel orders due to pricing errors or stock unavailability. Title and risk of loss pass to you upon dispatch to the carrier.
4. Australian Consumer Law & Warranty
Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality (such as a defective NFC chip upon delivery) and the failure does not amount to a major failure.
5. NDIS Consumables Statement
EveryTags and related hardware are designed to meet criteria for low-cost assistive technology and consumables under the National Disability Insurance Scheme (NDIS). However, eligibility, claim approval, and reimbursement depend entirely on your individual NDIS plan, funding categories, and goals. Tag Everything does not guarantee NDIS funding reimbursement or claim acceptance by the NDIA or your plan manager.
6. Limitation of Liability
To the maximum extent permitted by applicable Australian law, Tag Everything and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation: personal injury, allergic reaction, medical error, loss of data, loss of property, or device malfunction arising out of or related to your use of or inability to use the App or physical tags.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Victoria.
